Lake Chatuge at a Glance

Lake Chatuge is one of the highest major lakes in the state of Georgia — sitting at full pool elevation of 1,928 feet above mean sea level in the Southern Appalachian Mountains of Towns County. The Tennessee Valley Authority built Chatuge Dam on the Hiwassee River in 1942, completing a project that had originally been planned as a flood control measure but became a vital part of wartime aluminum production. The dam required relocating over 300 families and moving hundreds of graves from the Hiwassee River valley. Today, Cemetery Island — a small piece of land in the lake that holds 30 graves whose families declined relocation — is a visible, tangible reminder of the human cost of the reservoir's creation.

The lake straddles the Georgia-North Carolina state line, with approximately 3,500 acres on the Georgia side in Towns County and approximately 3,700 acres on the North Carolina side in Clay County. This two-state geography is not a curiosity — it is a practical buying consideration. The county, the tax structure, the school district, the building codes, and the permit authorities all change depending on which side of the state line your property falls on. The Georgia side has Hiawassee and Young Harris as its closest communities; the North Carolina side has Hayesville. Each has different property tax rates, and the Georgia side — with Towns County's notably low combined millage rate — offers a meaningful tax advantage over comparable properties in many other lake markets.

TVA Controls the Water — And That Has Real Consequences

The Tennessee Valley Authority owns and operates Chatuge Dam under federal authority, and TVA's management decisions affect every property on this lake. The most important of those decisions for property owners is the annual drawdown. Unlike Lake Jackson south of Atlanta — where Obermeyer gate upgrades eliminated the drawdown in 2012 — TVA intentionally lowers Lake Chatuge approximately 10 feet each year, from full summer pool down to winter pool, as part of the system-wide flood control operation. The drawdown typically begins in fall and the lake returns to full pool by late spring or early summer.

What this means in practice varies significantly depending on where on the lake your property is and how steep the terrain is. Properties on rolling or steep terrain with deep water in front of the dock may see minimal practical impact — the dock stays usable even at winter pool. Properties in gentle, shallow coves can see the water recede significantly, leaving docks high and dry or sitting in very shallow water for weeks. This is one of the critical due diligence items that every Lake Chatuge buyer should evaluate for their specific property — not as a general abstraction, but by asking to see the depth at the specific dock location at winter pool and by visiting the property in late fall if possible.

TVA Dock Permits: Section 26a Is Federal Law

Every dock on Lake Chatuge requires a Section 26a permit from TVA. This is federal permitting under the Tennessee Valley Authority Act, not county zoning. The application fee for a residential dock is $500 for new construction, $250 for a transfer of ownership at closing. Permits do not automatically transfer when a property sells — the new owner must apply to TVA within a reasonable timeframe after closing, and the process typically takes 60 to 100 days. TVA will conduct a site visit as part of the review. If the dock is not built exactly as it was previously permitted, the transfer application is treated as a new application and the full review process begins fresh.

TVA's eligibility rules are also important: not every lakefront property qualifies for a dock permit. Eligibility depends on the land rights attached to the specific parcel — some shoreline is zoned by TVA in categories that do not allow private residential structures. The Land-Under-the-Water Question

This is the Lake Chatuge due diligence item that experienced local agents know and that buyers from outside this market almost universally miss. When you purchase lakefront property, the deed and survey define where your property boundary ends. On Lake Chatuge, depending on the specific property and its survey, that boundary may extend to the 1928 TVA contour line, the 1933 contour line, or some other elevation. The question of who owns the land between your deed boundary and the actual water is not trivial — it determines who controls what you can do at the waterline.

There have been cases at Lake Chatuge where a third party owns the strip of land between a home's lot boundary and the TVA shoreline. In those situations, the homeowner cannot install a dock without the third party's permission — and some third parties have demanded compensation before granting that permission, or have refused to cooperate at all. TVA ownership of the shoreline strip is generally preferable to unknown third-party ownership because TVA operates a clear permit process. Before purchasing any Lake Chatuge lakefront property, have a local real estate attorney review the deed to confirm exactly where the property boundary lies relative to the water, and confirm who owns the land between the boundary and TVA's contour line.

Towns County Property Tax: One of Georgia's Lowest Rates

Towns County, which covers most of the Georgia side of Lake Chatuge, has one of the lowest combined property tax rates in the state of Georgia. The 2023 Georgia DOR Ad Valorem Tax Digest reports Towns County unincorporated M&O at approximately 4.286 mills, with the Towns County school district adding approximately 7.523 mills — a combined total around 11.8 mills for unincorporated Towns County properties. On a $600,000 lakefront home at 40 percent assessed value with a standard homestead exemption:
